組織適逢十周年,在這個重要的里程碑上,如何慶祝、回顧與展望呢? 除了傳統的慶祝儀式,還可以如何引發同仁擁抱光榮歷史齊心邁向新未來? 六月份朝邦對話新訊息介紹一個真實個案,如何藉助朝邦文教基金會的對話引導,連結熱情,找到新的行動契機。
法扶會十周年里程碑──啟動對話的契機

2014年適逢法律扶助基金會(1) (以下簡稱法扶會)成立十週年,過去9年多以來,共計有超過70萬人次向法扶會申請,該會亦已提供超過19萬人次的法律扶助。
雖有以上成果,惟面對台灣社會環境情勢的多變、弱勢團體的期待、民意機構的監督等,反應出了法扶會現況中仍有再改善與成長的空間。展望未來,法扶會應如何面對外在環境的變化,規劃短、中、長期之政策方針,進而制定策略來回應社會各界的期許?組織內部對法扶的核心價值與理念是否需重視檢視,進而形成對未來願景之共識?分散於全國各縣市的工作同仁又是否能認同?以上種種,皆促使了法扶會啟動組織內部對話的契機。
朝邦團隊規劃對話活動-引爆變革之心
為凝聚組織內部之共識,法扶會透過海棠文教基金會的介紹與朝邦文教基金會吳咨杏執行長接觸並邀請其引導團隊規劃對話活動。透過會前會、訪談,引導團隊根據法扶會總會的需求設計活動當日的對話流程。第一次於2013年11月30日舉辦董監事與全國分會會長、執行秘書的對話活動。又於2014年4月29日舉辦了「以共創願景未來角度暢談法扶三年工作目標」之活動,邀請來自法扶總會及全國二十一個分會等將近50名員工代表出席。
4月29日活動當日由法扶會陳為祥秘書長進行開場致詞,勉勵全體同仁以扶助弱勢民眾之法律需求為使命和目標,也期待員工以宏觀的角度來看法扶會的未來,並在工作中找到熱情所在。隨後由朝邦文教基金會薛碧雯、陳明勇引導師接手當天以對話、分享及共創的方式帶領大家以小組進行暖身活動,在透過小組成員共同完成個人形象的彩繪,很順利地拉近了來自各縣市有點熟又不太熟的同仁間的距離。之後由引導師帶領大家運用肯定式探詢的討論方法,以二人一組彼此訪談,回顧投身法扶工作以來最令人感動和值得驕傲的工作體驗,淬取正向核心,重燃加入法扶工作的熱情和初衷。帶著投入法扶工作的熱情和理想,引導師運用團隊共創方式,引導法扶同仁們一起來想望法扶未來三年的理想景象,讓當場40位參與的同仁對於未來可能實現的事情,這過程像是具體的景象一一呈現在眼前。在下午開始的體驗活動除了讓大家透過近距離肢體接觸、一起討論、激盪出「解開結」的團隊建立歷程之外,再次感受實現未來情境規畫前,團隊成員需要開放彼此心胸接納多元觀點的重要性。最後階段,引導師以開放空間會議之模式,帶領同仁延續上午所共創的未來願景理想景象,進一步聚焦討論如何實現未來願景所需要的相關議題和行動方向。
在整天的共識營活動結束前,引導師邀請所有出席的夥伴分享一天下來的學習心得與收獲;現場的分享中,有很多的笑聲、成員們聽到許多不同的意見、在各分會工作經驗的交流中得到很多的收穫。從每一份同仁由衷的分享和回饋,可以感受當天同仁們相當投入在彼此開放、多元的對話氛圍中,在多元意見的分享中,也看到同仁們的熱情和參與。
跨分會參與式對話──注入改變的動力
法扶會是一個擁有21個分會的大家庭,每一個工作同仁多來自於不同的工作背景,因著對弱勢服務的,熱忱而在各自的工作領域上努力。因此,如何讓每一位法扶人皆能思考、對話與暢談,使共識自然而然由團隊產生,成了過往願景或政策形成時期的一大挑戰。相較於法扶會多以傳統會議形式進行議題討論,本次的活動帶來的是一個全新的會議與對話方式之體驗,特別是在引導師的協助下,引導與會夥伴以對話、分享方式進行深度交流,且在有限的時間內,有效率地為議題找出創新的意義及可能性,進而找到新的行動契機。然而,對話與溝通是一項持續性的重要工作,因此,未來法扶會也將鼓勵夥伴多加運用創新的對話模式進行議題討論或政策發想,也期盼每一個法扶同仁透過聆聽、探詢的溝通中了解,創建一個尊重、包容彼此想法的工作環境。
註1.法律扶助基金會簡介
法律扶助,是指對於需要專業性法律幫助而又無力負擔訴訟費用及律師報酬的人民,予以制度性援助,以維護憲法所保障之訴訟權及平等權等基本人權。
財團法人法律扶助基金會是依法律扶助法成立,自2004年7月1日起正式對外提供法律服務,服務內容包括法律諮詢、調及和解之代理、法律文件撰擬,訴訟之代理或辯護等,而服務的對象主要係針對無資力或其他原因(如強制辯護案件、申請人因智能上的因素無法在法庭上陳述等)無法受到法律適當保護者。
自成立以來,法扶會陸續於全國成立21分會直接受理職災勞工、受暴婦女、原住民朋友、外籍勞工、外籍配偶、卡債民眾等經濟弱勢的民眾申請、透過2800多位扶助律師提供符合資格的民眾訴訟代理、撰狀、調解及法律諮詢服務、透過下鄉或視訊提供遍遠地區法律諮詢,積極宣傳讓需要的人知道法扶。

What’s a good way to celebrate an organisation’s tenth anniversary so that we can together reflect and look forward into the future? Other than the traditional ceremony, how else can we lead colleagues to embrace our past and move into our new future with an aligned intention?

The Legal Aid Foundation’s 10 Year Anniversary: an opportunity to begin dialogue

2014 is the Legal Aid Foundation’s (LAF) tenth anniversary, marking over 700,000 applications for LAF’s assistance, and LAF providing over 190,000 people with legal support over the past 9 years.
Despite these achievements, Taiwan faces an ever-changing social environment where the growing expectations of vulnerable groups and civic supervisory bodies reflect that the LAF has much room from growth and improvement.
Looking forward how can the LAF face the ever changing external environment? Shall we plan short, medium and long-term policy guidelines following by strategies that respond to the community’s expectations? Internally, do we need to return our attention to the LAF’s core values and philosophy? On this tenth anniversary, the LAF addressed these many questions through an internal organisational dialogue.
The CP Yen Foundation team designs a dialogue activity and spurs our desire for change.
In our search for organisational consensus building approaches, the Begonia Foundation (財團法人海棠文教基金會) introduced the LAF to CP Yen Foundation’s Executive Director Jorie Wu, through whom we were able to invite a facilitation team to plan a dialogue activity for us. Through pre-meetings and interviews the facilitation team learned about the LAF’s needs and designed a dialogue program for that day.
The first meeting was held on November 30, 2011 among directors, supervisors, the national branch president and the executive secretary. Then on April 29, 2014 we invited a larger group including LAF’s twenty-one national branches of nearly fifty employees to participate in a dialogue focused on co-creating LAF’s future vision and three-year work goals.
On the morning of the April 29 meeting, the LAF’s Secretary General 陳為祥 gave opening remarks encouraging participants to view the LAF’s future broadly and to find passion in their work. Following, the CP Yen Foundation facilitators 薛碧雯 and 陳明勇used creative small group warm-up exercises to get to know one another better and to smoothly create a sense of closeness among the participants from cities across the country.
Following the warm-up, participants paired up and used appreciative inquiry to reflect on each other’s most moving and proud experiences at the LAF, this in turn rekindled our enthusiasm and shared values at the LAF. The Facilitators then led the 40 participants to dialogue about their ideal image and possibilities for LAF’s future over the next three years. During this process the more specific we became the more our vision emerged before our eyes.
In addition to growing closer to one another, talking together and doing an ‘untying the knot’ team building exercise, in the afternoon we began to explore our future scenarios. Participants learned to open up their hearts to receive the many different perspectives about what participants view as important.
In the final meeting phase, the facilitators led participants through an open space meeting process to continue the morning discussions about co-creating our vision about the future and added the task of focusing on how to realise what the future vision needs by addressing relevant issues and actions.
Before the end of our day-long retreat, the participants were invited to tell each other about what they’ve gained from this experience. During the sharing there was much laughter and participants gained a lot from hearing each other’s opinions about their different work experiences. From the participants’ heartfelt sharing and feedback, I could feel that they were really engaged and open to one another, they were enjoying the atmosphere of dialogue and diverse perspectives, and they were feeling passion and participation.
Cross-branch participatory dialogue: injecting a momentum for change
The Legal Aid Foundation is a big family with 21 branches and colleagues from a diverse mix of professional backgrounds who passionately serve the marginalised while also working hard in their own sectors. So how can we help LAF colleagues to think, dialogue and talk in a way that naturally produces group consensus – historically a key challenge to the formation of vision and strategy? Compared to the LAF’s traditional meeting style, this facilitated dialogue brought an entirely new experience; particularly with the assistance of facilitation, our discussion exchange reached a deeper level and even within a limited timeframe we efficiently found creative possibilities and opportunities for action.
Dialogue and communication is a continuous and important work so in the future the LAF will encourage colleagues to practice creative dialogic approaches in the way we address issues and think about policies. Moreover, I look forward to LAF colleagues using listening and inquiry in their regular communication to understand and to construct a respectful, empathic work environment.
An Introduction to the Legal Aid Foundation
The Legal Aid Foundation reflects the need for professional legal help among people who cannot afford the costs of litigation and attorney’s charges by providing institutional aid for the protection of the constitutional guarantee to the right of legal action, equality and basic human rights.
The Legal Aid Foundation incorporated on July 1, 2004 to formally provide legal services specifically, counsel, mediation, reconciliation, legal document support, litigation agency or defense, and other services for those who lack the means of self-defense due financial or other reasons such as in mandatory defense cases where the applicant is unable to make statements in court and may lack proper legal protection.
The LAF will continue to serve the country through its 21 branches who can directly receive cases related to occupational injury, domestic violence, aboriginal matters, foreign workers, economically disadvantaged people and provide counsel through more than 2,800 qualified lawyers accredited with the ability to represent the public. We strive moreover to provide legal information to remote locations in the countryside and through video to let people know that there is legal aid.
